The 4.33 BTC you get is because you release the 5 BTC after escrow checks the balance, etc.
So no, I would want to get the 5 BTC after you withdraw. I will need it after escrow checks everything is as described.
You get the bitfinex account and the email account so there is no way for me to reclaim the account since even the email will be in your control.
