I still use for investments ETH my ICOs, since most projects are using smart contracts! ETH transactions faster, more favorable Bitcoin at this time!

The crowd sale was never on chain. There was no main net yet, the genesis block hadnt been mined.

People received what might be conceived as an IOU which could qualify as a security. However for that to be seen as such, one would have to establish the value initially payed for the IOU and the value of that IOU at the moment the genesis block was mined and the IOU could be redeemed. Since there was no exchange trading ETH at genesis, I think thats going to be a difficult case to make.

My thinking to all of this is, since the DAO incident, ETC kept the original chain but not the ETH ticker. While ETH kept the original ticker but forked from the ETC chain, technically ETH never had a crowdsale. ETC if anything, should be the one labeled as a security.
