well if it really did happen then it is likely his fault that it happened. onlyperson to blame is himself. that's bitcoin for you. that's how it was designed to work. you are your own bank. so you have to step up to the plate and keep your money safe. 
maybe next time he'll set up an HD wallet and keep the seed offline on a titanium plate.
