You can't absolutely prove anything but math. So it isn't that much about proving it as it is using evidence to convince the grand jury to believe he has committed a crime.

And about that evidence: Linking wallets to ID is actually easier today thanks to groups like chainalysis, and it doesn't need to be Musk's own wallet that benefits from it for him to be guilty of market manipulation. He also has stated publicly that his son owns Doge. "Just kidding" isn't going to be a defence for it in the world of adults.

To top of that musk seems to keep up giving middle finger to whole justice system, and even if justice is blind, i am guessing that won't improve his changes in this case.
