The International Emergency Economic Powers Act (IEEPA) was mainly enacted as a Cold War strategy to protect the US from its enemies. However, Trump has not justified that the countries on which he had imposed these tariffs are enemies of the US. He has not proved that all of these nations pose a threat to the economy of the United States.
The court is saying that if Trump thinks that
the trade deficit is a danger to the US economy
you, he should simply increase spending on industries and ensure that American products become competitive. If he thinks that fentanyl transported from China, Mexico, and Canada is a national emergency, combat it by protecting the borders and going after drug dealers. The court is saying that Trump is treating the right sickness with the wrong drugs. Businesses in the US are suffering because he is not fighting the war against drugs with the right approaches. Maybe the tariff on China can be justified since there is a Cold War between these nations. But how can we justify the tariffs on the EU which are strong allies of the US.
One thing is to have sweeping powers but the application of such powers can be challenged because the US is not an authoritarian nation like China.
