Then again your probably a person would advise a woman to get raped as opposed to fighting back, because hey you could get hurt more. What if the woman being raped picked up a knife after the rapist was done and killed him. Would you charge her for murder and possession of a weapon?
Yeah, thats voluntary manslaughter if the women kills the dude AFTERWARDS.
"Voluntary manslaughter is commonly defined as an intentional killing in which the offender had no prior intent to kill, such as a killing that occurs in the "heat of passion." The circumstances leading to the killing must be the kind that would cause a reasonable person to become emotionally or mentally disturbed; otherwise, the killing may be charged as a first-degree or second-degree murder. - See more at: http://criminal.findlaw.com/criminal-charges/voluntary-manslaughter-overview.html#sthash.42ZjdBGr.dpuf "

"A police source told the Daily News Smith and Copobianco were fighting over drugs, specifically heroin."
So it was the Bitcoin or the heroin that made them go loco?

You guys aren't getting the big picture, self defense in the lovely state of ny, and they want to prosecute him for murder? Hey you escaped your captors and did what you had to to survive, sorry we are putting you in jail for life. Next time why don't you just lay down and die.
.....Welcome to the progressive new pussy world
Doesn't sound like self-defense to me, not even in Redneckistan.
I grabbed the hammer from the kitchen and hit Jessie three or four times until he was unconscious,
Dude #1 walks into kitchen, grabs hammer, goes back to the living room and beats dude #2 to death. It's not like dude #1 pulled the hammer out of his waistband to defend himself.

1. $2750 rent per month for one-room apartment in Queens??
2. 29 year old "lawyer" living with an 18 y/o in a one-room apartment? Sound like a man-boy love thing.
