Have fun from Fiaz:

"Hey guys,

To all those who are not happy with this proposal and are demanding a refund I will start with copying part of the update as it does address this: Just as a reminder what has happened since the start: you pre-ordered a product, then competitors arrived on the scene. In order to secure your loyalty, we increased the hashrate to 90Mh/s which is fair enough, then we took final payment at 90 (if we were any other company: chances are we would have as we could have stopped at this point, that is a fact), we then decided to increase to 250Mh/s despite the fact we didn't need to. We delayed and despite the fact our terms give us leeway in this: for the sake and in the interests of our customers we still decided to go yet another step further by giving you shares of our company for the rest of its existence without the need for you to spend an extra penny or work for us hence there is no catch this is technically something for nothing in so far as what we are legally obliged to provide you. All this on top of free shipping for batch 2 and 10% off any future batch of your choice; this is an unprecedented level of customer service. We have been crystal clear from the start with our cancellation policy so why you would order from us if you didn’t agree with it or worse you thought it wasn’t legal is beyond me. Customers who do not pay in full will of course not receive shares in our company, their orders will be cancelled subject to our cancellation policy; this is the final word on this. And while technically the due date has passed we of course haven’t cancelled anybody’s orders but at a certain point enough is enough. If we were any other company we wouldn’t be having this discussion, it is what it is, if I may be so bold we have gone above and beyond the call of duty for you; this is a fact. I am sorry it is your perception that you believe you are entitled to more from us however we have nothing left to give and can do nothing more for you. You paid for a 25Mh/s miner and everything on top is goodwill, this is simply a fact.

Thank you and I am sorry if my responses are too blunt I will work on it Smiley I am just proud of my company taking this action as I know these choices are never easy and it is always tempting to take an easy way out yet here we are doing our best and you can't ask for more than that. How many other ASIC companies out there would have gone to these lengths to keep your custom and loyalty. In any case I will leave the legal and executives to lay out their plan to you in the next update hopefully. Sorry for this sloppy post I will clean it up as soon as I can.

So in short we will not allow customers who only pay 30% to join the company and their orders will be subject to our cancellation policy. This is the final word on this as such any posts on this will be deleted and the poster will be PM'ed this post. I am sorry if this sounds harsh to you but the bottom line is aiming your frustrations at me will change nothing and not help you in any way: it is what it is and while it should go without saying: this is our final word.

You have paid for a miner which you will get, nothing has changed regarding this transaction except that we are giving something extra. I would like to say to some people that I have only been responding in kind to complaints that are unwarranted so if you would please work with me here constructively in order to help you instead of this hostility and nitpicking about pointless things just for the sake of it we will get somewhere and you will be better off for it as we've proven we directly make changes based on your input in this forum. This is just a fact that has obviously not gotten across to everybody yet; my goal and sole intention here is to work with you and help you so help me to do that instead of hindering me as you will only be helping yourself. Surely this makes sense?

Now if you take issue with my stance on this you are welcome to PM me."

A bit early to say but it looks like a recovery point is forming.
might be worth to observe the next 1 or 2 hour.

I'm more surprised each day to see what little volume is required to push the price around...

When demand increases properly after RC4, the moon wont be enough...

Any news about RC4?

So most people will probably blow this off as TA (Technical Analysis) non-sense and I don't like sharing patterns to begin with as it encourages people to try "trading" rather than investing which most people are not mentally or emotionally equipped for but I feel bad for some of the people selling. The people who have bought darkcoin thus far have helped support a blossoming technology which I think can help to solve a lot of the problems in the world. If you own darkcoin, for the faith you have placed in the devs and the idea that is darkcoin, you deserve to be rewarded. Maybe not this week, maybe not 3 months from now but eventually, you will be rewarded and the world will be a better place with secure, anonymous transactions which you helped to support during its development phase. To help some people sleep better, I share with you these charts.

What you see here is gold back in the 70's. This is a monthly chart and shows what some would call a bullish pennant or bullish flag. If you disregard the huge run up which constitutes the "pole" of the flag, you have a descending triangle which is indicative of continuation in the direction the asset was moving prior to forming the triangle. Statistics have shown that around 70% of the time, these triangles break up successfully to the upside when formed after a large run up. I don't expect you to believe me, I expect you to go and do some research yourself. I am giving you enough freebies today.

Now, here is a darkcoin chart with the same descending triangle that I made a short while ago. Notice any similarities? Look at the waves, the overall pattern formed from the high to where it finally broke out of the triangle. These waves can be of different sizes. The triangle can be touched in different places. The length of the triangle can vary... but as long as the overall pattern and movement stays the same, the pattern is not broken. Can you guess where we are in the pattern right now?

Now you may think this is just a coincidence. Or you may think that a pattern that appears on a monthly gold chart does not apply to a 4h darkcoin chart. However, many of TA patterns are fractals. Patterns within patterns within patterns all occurring at different time frames that display the collective conscious of traders and investors. I have seen this pattern across blue cap stocks, monthly and weekly options, forex, commodities and most recently, bitcoin. I have traded this pattern many times and my win percentage does fall around 70%. Perhaps darkcoin continues the pattern, perhaps not. Regardless I am investing in darkcoin, not trading, and am using this opportunity to buy enough darkcoin to setup yet another masternode.

Earlier, I asked you to guess where you thought we were in the pattern. Here is a 12h bitcoin chart. Can you see the pattern now?

Remember, hoping the price goes up or exclaiming and crying when it does not, is not helping anyone, especially yourself. Instead, take this opportunity to learn about market dynamics. Research Fibonacci retracement, consolidation patterns, how markets are manipulated or even better, use this as an opportunity to learn how to control your irrational emotions and instead, analyze the world around you through a logical viewpoint. I wish everyone the best and I hope many continue on this journey with me of distributing power and decentralizing control. We may not reach the moon, but we are heading places we can only begin to imagine. This is the first of many steps towards the Singularity.

Tabula Rasa my friends...

Thank you

@lucaing. Yes you are right.

What brian_23452 said is pretty much spot on. They are dishonestly claiming the products are only for business use, even though they are selling to consumers. Furthermore this position has evolved, as when initially asked why full refunds weren't given, they said on Jan 10: https://litecointalk.org/index.php?topic=2859.msg94545#msg94545

"In regards to DSR. 7 days after you RECEIVE your product you are entitled to a FULL refund including deposit. This is once final payment is made.

That has no relevance with deposits pre final payment and pre shipping. If a customer decides after agreeing to our set agreements to pay the deposit. And then decides they do not want the product or want to pay final payment. They forfeit the deposit and by law we are allowed to take full deposit. But once again as a courtesy we are giving back deposits as well.

Please do your due diligence and full research. We have checked and confirmed all our rules via the international regulations.

You should contact the DSR and any authorities regarding this case for your self satisfaction.

Alpha Technology Team"

This is complete bullshit and was quickly discredited, so they changed it to this on March 24: https://bitcointalk.org/index.php?topic=314402.msg5875510#msg5875510

"You are not classed as a consumer to us. Our devices are sold and are classed for business use, cryptocurrency mining earnings in the UK is classed as income and is taxable, our units are used purely for mining, therefore every customer is classed as a business-user. It is your duty to register as a business and class your mining earnings from our devices to the relevant governing bodies. As we are selling for business use only therefore our terms of conditions are what you have to comply by as you accepted before you ordered."

More bullshit. None of this is in even in their T&C's. Even if it was, it doesn't matter. As Alpha selling to consumers. What the product could be used for is irrelevant. If you are not buying through a business and the product is for your own private use, YOU ARE CLASSED AS A CONSUMER.

As alpha are not strictly a B2B supplier pretty much EVERYTHING in their T&C's is irrelevant and superseded by UK law.

You can see a clear evolution as they make up policy as they go along to avoid paying refunds and flout UK consumer law.
As they are a UK registered company they are bound by the law of the UK. In this case the Distance Selling Regulations 2000. Even if you do not live in the UK or the EU, the law applies as Alpha are based in the UK.

Email Alpha stating that you had intended to use the product for private personal use and not for business. If they are a decent, honest company they should void your order and issue a full refund. They won't of course but you will have their reply on record. I hope this helps

Let me just say: Ty for your awesomeness!!
(I'm too tired to be more articulate but wanted to show my appreciation for this  Grin)

Me too!
Thank you very much!!

I've been lurking on their forums again, an IP ban is pretty easy to get around.

I managed to shame Fiaz into posting on the "Chip status" thread before getting banned again. It really wasn't worth it though. Here's what he wrote:

"Apologies for the delay, we are very busy with orders but very soon we will have a big update releasing fulls specs and more details".

Not too busy to spend all day on the forums arguing and banning people, just too busy to answer a really important thread.  Looks like more stall tactics from Alpha until they can scrape together enough money to pay the bills.

By the way I talked to the Citizens Advice Bureau again today. I updated them on the situation. They have flagged the case "criminal withholding of consumer rights" and passed it on to Trading Standards. They'll contact me in 5-10 working days if they decide the case has merit. Anyone who is NOT A BUSINESS and has or is having their refund, partially or fully withheld should contact them direct on 08454 040506 or fill out the form on their website

https://ssl.datamotion.com/form.aspx?co=3438&frm=citacomplainform&to=flare.fromforms

You need to complain. Not just post on forums. The more people who bring this to their attention the faster it will get resolved.

Some of us got together on the Cointerra forum and complained to the Better Business Bureau and they issued a warning to the press (http://www.latimes.com/business/technology/la-fi-tn-bbb-bitcoin-warning-20140605-story.html). Cointerra were getting slammed so hard they had to shut their forums down and guys who had been waiting months are finally getting refunded.

Just to be clear. If you are not a business customer you are entitled to a 100% REFUND UNDER UK LAW.

If you are unhappy with the refund situation contact the CAB and complain. Unlike the BBB, Trading Standards has the ability to bring criminal charges. They take this sort of thing very seriously in the UK.

Thank you very much for the informations!!
The law is valid for EU citizens only or even for extra EU citizens? i think it's valid for everyone because their business is located in UK, am i right?
