So if I am seeing this correct, Alpha is claiming to have the chips in hand, but we are shown a picture taken of the chips in India @ Dexcel, per the GPS tag on the photos, correct?

If you paid by CC, you should have just done charge-back a long time ago. Small claims is last resort option, basically. Additionally, you should absolutely have the courts change your address to one of the paid for addresses in the UK immediately or the court will strike out your claim and you will have to appeal it. You can very easily fight this particular defense like the above mentioned with receipts, etc.

you need to read back much further. there's a shitload of stuff here.....


Alpha has violated the following:

Claiming Paypal would be an option for final payment and not offering it.
(Now they say they are offering it at the end of development, but that would be impossible to offer it 8-10 weeks prior to shipping)

One-sided compliance with obligations
They requested final payment for delivery 5/22/2014 and 8-10 weeks have passed and the product is nowhere near shipping.

By requesting final payment for delivery and then pulling the option for credit card transactions only days later
(Thereby forcing buyers into an unprotected transaction.)

Misleading Omissions
By trying to fool their customers into believing this was a business to business transaction without telling them ahead of time
The Consumer Protection from Unfair Trading Regulations 2008

Quoting HMRC saying this is a business transaction because mining devices can only be used for mining.
But HMRC actually says:

"The customer is not eligible for a full refund or chargeback as per our terms and conditions.. bla bla bla"
Everyone who requests chargebacks through their credit companies being granted them. Alpha is in violation.

By trying to illegally fool their customers into believing consumer laws do not apply to their transaction.

By attempting to limit our legal rights

Not honouring statements made by the trader's staff
Numerous times, all over the forums, A.T. employee Fiaz Malik has assured everyone that delivery of the product would be no later than July 31 (in an attempt to get customers to pay for a product that is nowhere near ready)

One-sided interpretation of the contract
If you request a refund and you are denied and you paid in January, they are violating their terms
Reason: Terms only state less refund at 3-5 months but nothing about no refund between 6 months and final delivery!

Oh, and because today is August 1...
Failure to deliver product or show any physical evidence that it actually exists by the deadline specified in the contract.

Oh, and...

This is how Alpha renigs on their plan for giving everyone shares in the company, because they see now just how illegal and impossible it is for them, LOL....

I've won my claim against these guys, the court has now granted my judgement.

It cost's £70 to get the court to enforce this judgement, which will involve them sending bailiffs to the head office. Seeing as how that office has already been reported to be empty, is there any other address anyone knows of I can send the bailiffs to seize goods?

gloating in somebody else`s misery does not display great character...

Not picking sides, but the same could be said about all the people who refused to look at the facts of the company (myself included), who refused to listen to the people who made valid points about how this is a scam and would become vaporware, and insisted on sending our money over to them regardless of the repeated warnings from people who had nothing to gain by trying to help others out by warning them (again, myself included ;p ).

Does anyone have a copy of the original terms that didn't have any of the crap about after 5 months no refund?

I am disputing this with my credit card and alpha tech linked them to their current terms that they've changed about 18,000 times now.

If I am mistaken please tell me but I remember originally it just being 70 pounds to cancel.

How many months after payment did you manage to get a chargeback?
But even if you get a chargeback, isn't that just being paid by the CC company instead of AT?

Good ol' fashioned credit cards. Got my refund. GG.

Negative. The credit card companies don't play the role of insurance. Whatever money people are getting back is coming directly from some account of the Mubasher mother fucker.

This is their standard answer to everybody, at least they answered on my debt collector mails...

And they lie about the refund, I have been asking for one got nada...


Yeah... decent try with the debt collectors but Alpha will never acknowledge a debt in your favor and those attempts are virtually useless as they have no credit that can go bad (other than their customers' which is already in the negative). You need to sue them.

As stated, what they are attempting to do is insanity. It is not illegal to tell people your plan. They have announced their plan to offer shares. That is all. They have not offered shares.

Correct, they will not be able to do this as there is a plethora of reasons why they cannot.

Why they offered this? They are ignorant children under the age of 27 trying to run a business who have heard various solutions that various companies have had in the past to deal with various problems and they shouted this out to everyone real fast.
They have not done ANY research at all into this matter, clearly.
The other possibility is that they simply came up with a real scam and this is it.
The third option and the absolute least likely, is that they will actually go through all the work to make the company a legitimate publicly traded company. (RoFLMAO HAHAHA WTF LOL)

As far as your contract and order goes you can view it this way
They have not violated their contract yet by trying to add things to it (shares)
If you paid in full (and my god I am so sorry for you if you did) after they announced the share plan, then you are entitled to a full refund when you are not given shares in the company by the time batch 1 ships.
If you paid in full BEFORE they announced the plan for shares, then you are out of luck all together.

Again, not a lawyer here, just the most logical person I know.
