Bitmine.ch was and is the one profiting the most (by far) and thus is, has and should also bear most risk. Not customers.
Customer protection laws are quite strong here too.

http://www.coindesk.com/avalon-asic-customer-bitcoin-refunds-delivery-delays/

Can't imagine why haven't they asked for their refund.

... they won't let us early investors, who provided them the cash to even start their bitcoin business, down with a complete loss.

They do not recognize this. In previous emails exchanged with them, I made clear we invested on them. Their answer was as cold/rude as it could be. "We do not sell investments, we sell products."

If buying a non existing product from a non experienced "company" based on promises is not an investment on them........

I am wondering too - and this is roughly what I would like to hear from them:

Cut the Avalon nightmare short - get refund for ordered chips - and offer bitmine.ch 2nd gen upgrades/replacements.

Else refund the customers that wish to do so.

In less than two weeks after getting the chips, the first Avalon clones where manufactured and left our warehouse in Camorino, Switzerland.

While most of the customers opted to get their orders shipped, the very first units where picked up on Wednesday and some others will leave through UPS Express service. Tracking number will be provided once available for your order. Please note that the units are delivered according to the original orders queue, so your unit may not show up as shipped yet till next week. While we fully understand the pressure, please do not inquire about the status of your order as we are already doing the best to expedite the process and your order status will be updated by us as soon as updated information such as the tracking number becomes available.

Thank you!

How do the 2 weeks compare?
Unfortunately only the overall time is relevant imho.

Also it would be time to step forward and treat your early customers like they deserved it. What can customers expect in terms of upgrade options. We are waiting for months - and our estimated (now calculated) ROI got crushed within the last 1 month.

Hearing some (likely non customers) complaining that "the risk for customers should have been clear in the first place" - I have to strongly disagree with that opinion.

Bitmine.ch was and is the one profiting the most (by far) and thus is, has and should also bear most of the inherent risk. Not customers.

Waiting for real news.

Re: [Work in progess] Burnins Avalon Chip to mining board service

Not really. It is an assembly with a prefinished product. Last time I heard such a discussion and it went to court it was specifically important that the product is specifically made for the client, that is after his wishes, and cannot be sold without loss to anyone else.
Lets highlight this passage:
"and cannot be sold without loss to anyone else"
This is exactly the case here because no one would want buy these boards anymore.

As we say: In German Courts and the high sea, you are in the hands of chance.
precisely

announcement:
I won't be selling to end-users anymore.

Reasons:
  • Time. I want to provide you with BitFury and CoinTerra mining boards for which i need lots of development time.
  • Development and Manufacturing of electronic devices is my main qualification, not running an online-shop
  • I failed to provide adequate customer service.
Some of you never heard back from their requests.
  • The last 3 month i worked 7 days a week all day long.
This is slowly beginning to take its toll

Consequences:
  • I will continue to develop and build mining devices.
  • These will be exclusively sold in large quantities to distributors.
  • existing orders will be processed and delivered or refunded.
  • For the upcoming Bitfury Boards i am negotiating with a 3rd party to manage the end-user sales.
But i am open to anyone interested that has the infrastructure to handle it.

Further refund information:
I thought long and hard about this whole mess we're all in.
And i am NOT content with the current model.
50% refund is all i can offer >NOW< without going instantly bankrupt.
I plan give back more, if i can.
Therefore any reuse or resale of the remaining components will be refunded. (You bought these with your money after all)
That means you do not need to buy bitfury boards from me in order to get those extra 20% back.
If you can wait until then it could be sent in one transaction.  (about 2-4 weeks to wrap everything up)

I value fairness above most other things like profit for example.
That goes both ways, and almost all of you are upright honorable people which i am deeply grateful for.

To you paypal disputers: i hope you can accept the proposed solution.

Burnin - I am asking you to provide an as detailled as possible calculation of your spending/costs.

A plain statement of saying that you can refund 50% without going bankruptcy is hilarious imho - without providing further details.

Also your threat of sending out unfinished boards to customers won´t hold in a german court ruling; you are not fulfilling your side of a contract. The input (pre-production) of yours (material and time-wise) will very likely be counted to your disadvantage.

I am of course aware that you were only trying to provide a great service to your customers and as such pre-producing parts of those miners. Nontheless - this is case is not as simple as you are putting it and I am awaiting your statement.

So considering that ASIC orders are being cancelled and refunded - what are your plans bitmine? I am asking you for a statement ASAP!
(not about housing - but upgrades to gen II).
We are all in the same boat it seems.

First - let me ask this

ad. 2) -
Have you really offered upgrades to GEN II chips to your customers?
I have not seen anything else except a very vague statement regarding some offer (bitfury chips) - maybe being in the works.
No details so far - no offers - nada.

Also it seems the image you posted is clearly referencing the general terms of your last batch #3 only - not  the terms of batch #1 nor #2.

Ty for your reply.

2) We've already given a lot of refunds (many of these have been confirmed here on bitcointalk) BEFORE we started production and we offered a lot of upgrades to the next generation, in fact we are still planning if possible to upgrade for free to 400 Gh/s instead 200 Gh/s but is not sure right now.
....

And finally, the general terms of sale are that all sales are final, and this has NEVER changed:

I can only second that GandalfG.

Zefir - without knowing details of said transaction - I would very much assume that you didn´t do the deal in full selflessness.
If the price wasn´t right  - the deal would have never taken place. You got fine fiat and were furthermore derisking your investments!

Besides Bitmine´s efforts to speed up delivery - there are stil unadressed issues.

  • I.e. the change of return policy after the preorders were filled being the biggest one!
The risk was derived from Bitmine AG to their customers in an illegal way imho.
  • Another one being the outlook for a upgrade to gen 2 bitfury chips - which is not adressed anymore.
  • The third issue being the following (closely relevant to the second):

That´s part of a recent Bitmine AG PR sent out by it´s now majority shareholder (at least according to their news release):
    http://bitcoinprbuzz.com/established-multinational-investment-firm-plunges-into-bitcoin-funds-development-of-next-generation-asics/

    Quote
Massive Luck Investments is currently in the final stages of making pre-production arrangements of ASIC chip sets, based on the most advanced existing 28-nanometre technology, with both power consumption and hashing power characteristics significantly outperforming any existing or publicly announced Bitcoin mining ASIC technology. Some of these next generation ASICs may be made available to the public, but the great majority will be utilized in their own datacenters, for industrial scale mining.

So in essence Bitmine AG is turned into a mining shop - directly competing with the oh so valued customers.
This is a very bad move imo and makes me consider to exert the former return policy and cancel all my bitmine orders immediately.

I am still awaiting a reasonable statement from Bitmine AG.
