Did you get assigned to north Hampton county court to challenge this then? As this is a Manchester company I assumed they would be held at a court somewhere within Manchester

any new updates regarding the actual miner ? or any news regarding their company(+shares) ?? -.-

Oh, and the update is I have mailed back my confirmation of taking Alpha to court after they have tried to defend their lies. This will be in the UK court's hands on Monday.

He'll ignore you, he accepted my invite on LinkedIn, and then proceeded to disappear as soon as I ask him a question about Alpha Technologies.

We understand that a trader will not cancel a contract with you and you claim you purchased the contract as a consumer and not a business.

Your rights and obligations

When you purchase a contract you enter into a legally binding contract with terms and conditions you are deemed to have read and agreed to, if the terms do say that you are deemed to be a business then this is what you are legally bound to. The Consumer Protection Distance Selling Regulations would only apply to a consumer transaction and you should be given seven days to cancel in writing, if not then the contract would not be enforceable. We’d now suggest that you send a letter to the trader setting out your complaint and giving them a deadline to respond to you. Template letters are available on our website. Keep a copy of your letter and get proof of postage so you have evidence of sending and receipt in case you need it later on.

What we’ll do

We will notify Trading Standards of the trader's activities. Whilst this would not help with your complaint, this is valuable intelligence for them, which may be taken into consideration in any future dealings they have with the trader.

Dear Sir,
We have been asked to contact you because you have shown an interest in joining a potential class action against Alpha Technology (INT) Limited (Alpha).

The reason you will have shown an interest is because you will have paid either in part or in full for goods which have not been shipped to you by Alpha.

Alpha appear to have employed delaying tactics to their customers in respect of goods ordered and also informed customers they are not protected by the UK Distance Selling Regulations because the customer is a 'business'.

We are currently ascertaining a rough count of clients who would be interested in a class action against Alpha.  At this stage, if you would be interested, can you please confirm:-

1.  Your Name
2.  The date of your order
3.  How much you have paid to Alpha
4.  Your country of residence
5.  If you would be interested in joining a class action to recover the funds you have paid to Alpha

Once we have an idea of how many customers have been affected we will then be able to confirm a strategy to those who wish to be included.  We would provide clear details of how a class action works, what we can do to protect any assets held by Alpha, what will happen if it transpires that Alpha are guilty of fraud and also the estimated costs.

The main benefit of any class action is that the costs are divided equally between clients therefore making litigation viable for almost any client.
